Current Hemp Law Status in South Dakota

South Dakota repealed its state industrial hemp program in March 2026 through Senate Bill 39, shifting hemp-cultivation regulation to the USDA rather than a state licensing program. The state agency is the Department of Agriculture and Natural Resources, or DANR; “South Dakota Department of Agriculture” and “SDDA” are stale names from before the 2021 agency merger. South Dakota has not legalized adult-use cannabis. Voter-approved Amendment A was struck down by the South Dakota Supreme Court in 2021, and later legalization measures failed in 2022 and 2024. See the Marijuana Policy Project's South Dakota overview.

What's Changing in 2026

The major state-program change already occurred: South Dakota repealed its industrial hemp program in March 2026 and moved cultivation oversight to the USDA. The state's chemically modified hemp-cannabinoid ban is older. House Bill 1125 took effect on July 1, 2024 and prohibits chemically converting industrial hemp and selling or distributing chemically modified hemp products, including Delta-8, Delta-10, THC-O, HHC, and THC-P. Active enforcement began July 14, 2025.

Delta-8 Status

Delta-8 sale and distribution is already illegal in South Dakota under House Bill 1125. It is not lawfully “widely available,” and the November 2026 federal change is not the event that first makes Delta-8 sales illegal in the state. See the South Dakota Legislature's HB 1125 record.

CBD Rules

Federally compliant hemp-derived CBD is legal in South Dakota. Since the March 2026 repeal of the state industrial hemp program, growers register directly with the USDA rather than with a state hemp-grower registry. See the DANR industrial hemp page.

How the Scheduled Federal November 2026 Changes May Affect South Dakota Residents

Section 781 of the Continuing Appropriations and Extensions Act, 2026 (H.R. 5371), enacted as Public Law 119-37 on 2025-11-12, sets 2026-11-12 as the effective date for the federal hemp provisions. On that date, the federal standard applies a 0.3% total-THC test inclusive of THCA and delta-8, caps finished hemp products at 0.4 mg total THC per container, and excludes cannabinoids that are not naturally produced by the plant as well as naturally occurring cannabinoids synthesized outside the plant. On 2026-08-08, the Senate passed H.R. 6500 containing proposed one-month partial-delay language. That language was not enacted as part of P.L. 119-37. The November 2026 federal change is a separate, additional restriction. Delta-8 sales are already illegal in South Dakota under House Bill 1125.
